we're live in santa clara where police are warning people who live near the university campus that a woman was attacked early this morning. we'll tell you how she fought back and we'll have the latest on the investigation. the clock is ticking towards sunday night and the b.a.r.t. strike deadline, the grim warning that could be issued today. >> reporter: one man is dead. one is fighting for his life after a shooting on a busy antioch roadway. what we've learned this morning about the victim and the suspect's vehicle. plus -- why this is a big day in the legal battle tied to

morning. ktvu's janine de la vega is following this developing news from santa clara and joins us now live. good morning. >> reporter: good morning, tori. this happened a couple of blocks away from the university. a lot of students live in this area. we don't know if the victim in this case was a student but it happened near main and lexington. police tell me that the university police are aware of this incident and plan on cautioning students to be careful. officers say this happened at 1:30 this morning. the woman had been out with a group of friends near a 7 slrn 1 -- with a 7/eleven and dedecided to walk -- decided to walk home alone when she was grabbed from behind. and the man told her, don't talk, don't scream, she kicked him in the groin and he ran away. she wasn't able to get a good description. there are no indications that weapons were used in this

battery. the police used k-9s and a scent led them near the homestead and la fayette. but they lost the accident. police believe don't believe this is the same man suspected of raping a woman at kylie at homestead. investigators say that's because there was nothing sexual in nature in this attempted -- in this battery. instead, they are looking into the possibility of this may have been an attempted theft. they are still working on the motive. they are not ruling anything out. but at this point, there's no active search. they would still like to find the plan who did this, though. janine de la vega, ktvu channel 2 news. >> thank you, janine. police at san jose state university say they have a suspect in custody for a brutal beating. officers confirmed they've made an arrest in the campus attack on tuesday night. police are expected to release more details later today. the 22-year-old victim is still recovering after his head was bashed on the sidewalk near the

science building. officers say it appears the victim and attacker knew each other. the victim was not a student and had no sees to the -- no ties to the university. police are searching for suspects in a deadly shooting last night. police found two men shot in a car on summersville road. one man died. the other is critically hurt. ktvu's claudine wong has been out there since 4:30. what are the police saying now, claudine? >> reporter: well, it appears, dave, that the two victims were simply driving on the street when the shots were fired. if you take a look behind me. this is delta fair road. you can see glass on the roadway. they've opened the roadway. and the number of cars, it gives you an indication of how busy it is here. it was busy last night at 7:45, when all of this happened. i want to show you what happened out here when police were gathering evidence. this roadway was shut down

until about 90 minutes ago. again, this is where police say the shooting happened. it appears at this point, that these two men were driving down the street when another car drove up and the person or persons inside started shooting. the victims didn't stop, though, even both of them were hit by budget, -- by bullets. the. suspects drove away near somersville and that's where the officers found them. one man is dead. the other is in in the hospital in critical condition. police are still trying to notify the victims' family so they don't want to release other information. we expect more information later today. we're being told the man had ties to antioch. we have a description. suspect vehicle. it's described as a four-door honda or chevy. we do not know the model but we can tell you, it's gold in color. we know this -- the investigators have been busy connecting interviews all morning. they were out all night

gathering evidence. they are still trying to put that back all together. back out here live on delta fair boulevard. when all of this happened, there was a lot of cars coming in and out of here. they are hoping anyone with any information either witnesses or people who knew the victim will come forward and help them solve this case. live here in antioch, claudine wong, ktvu channel 2 news. 7:06. well, this morning, oakland police investigating a deadly shooting in east oakland. police find the body of a man who had been shot and killed about midnight on 80th avenue near international boulevard. so far no word yet about a suspect. new this morning, investigators in san francisco want to know what caused this early-morning fire in chinatown. it started about 3:00 this morning at a souvenir shop on clay street. not far from the financial district. there's no word of anyone being hurt. that fire caused about $5,000 damage. it is 7:06. to our continuing coverage of the threat of another b.a.r.t.

extradition treaty between the two nations. meanwhile, happening today -- the nsa's controversial surveillance programs will be topic one when lawmakers including senator dianne feinstein are scheduled to meet with president obama. ktvu's kyla campbell is live in our washington, d.c. bureau with the action feinstein wants to take to protect our privacy. kyla? >> reporter: well, tori, i spoke to her staff. they said she will be talking with the president today. so will other democrats and republicans from congress. senator feinstein is the chair of the senate intelligence committee. she's ordered the nsa to review how government surveillance could expose americans' privacy. but she's denounced former nsa contractor edward snowden leaking intelligence. snowden claims the nsa's tracked millions of americans' phone records. there was a discussion yesterday about this. >> those reports contained less

union workers plan to do today. tara moriarty is live in oakland. you've been talking to a union leader about a rally set for later today. >> reporter: that's right. that rally is set for 5:00 at frank ogawa plaza. they will be marching to b.a.r.t. headquarters. we've just learned that "occupy oakland" is planning on showing up at the event and perhaps making trayvon martin part of this cause. we noticed earlier this morning, there were several transport vans lined up in front of opd headquarters. police officers are on alert for the rally in case groups turn i slent. we -- turn violent. unions and marine managers met until 11:30 last night. b.a.r.t. unions had no idea that "occupy" was planning to show

up. >> i'm personally extremely sympathetic to the tragic death to trayvon martin. >> reporter: now, b.a.r.t. management has not responded to the union's latest offer which was made july 17th. if that's still the case tomorrow morning, unions will be issuing a 72-hour strike notice. the sticking points are still salary benefits and workers' safety. union leaders say the clock is ticking. that sunday midnight deadline, just looms there, and, of course, this is not good news for riders. and bay area traffic was snarled for four and a half days to be exact. we understand if the strike happens next week, there will be more riders out on the roadways this time making for an even messier commute. we're live in oakland, tara moriarty, ktvu channel 2 news. >> thank you, tara. other transit agencies are

preparing to pick up some of the slack in case of a strike. the san francisco bay ferry was a very popular option during the b.a.r.t. strike back in july. it anticipates more crowds if there is a strike. it plans to launch early and increase the boats. there will be more ferry runs between oakland, alameda and vallejo. a.c. transit will run its regular bus service but hopes to provide extra transbay lines depending upon the veaubility of buses and drivers. the bishop ranch business park, managers have plans for increased bus service from san francisco. they tell they hope to have an additional stop in the south bay. for any change in the b.a.r.t.

"like" ktvu on football or download the ktvu app. 7:35. new this morning, the federal government investigating reports of alleged unethical actions by lawyers in connection with the asiana airlines crash. the ntsb is checking reports that lawyers have been soliciting the victims. now, u.s. law bans lawyers from approaching passengers in the first 45 days after a crash. the ntsb says the complaints involve websites and the lawyers personally soliciting passengers. a burning candle may have caused a house fire in concord. it happened last night about 7:00 on bonacase street. luckily, no one was hurt. but the house we're told was a total loss. firefighters say the fire apparently started when a candle ignited curtains in a

back room. 7:36. garbage collection rates are going up in san francisco today. the average cost for three 32- gallon bins jumped from $28 a month to $34. customers, though, can offset the hike by switching to a smaller 20-gallon garbage bin and a larger 64-gallon recycling bin. the option is designed to help san francisco reach steer row waste by 2020. monday, night -- monday night, the palo alto are considering putting a stop to people sleeping in their cars on the streets. opponents plan to rally before the hearing. they say the measure criminalizes the homeless. tonight at north san jose, crews will spray for mosquitoes trying to stop the spread of the west nile virus. the fogging is due to begin at

11:00 p.m. the county is trying to give as you much early warning as possible. the crews went out and canvassed neighborhoods yesterday and handed out fliers telling the public about the spraying. they also said it's not harmful to humans or household pets. want to check in with sal. see what's happening -- traffic in the south bay. it's probably heavy in the south bay. interstate 280 through downtown. you can see it's slow getting up to highway 17. it stays that way into cupertino. we also have slow traffic getting into the north end of the valley from milpitas past 237. it gets back better after mccarthy ranch and zanker road. we have a crash blocking one of the lanes there here. traffic is slow. we move ovover to the hayward

-- we move over to hayward, just beginning at winton avenue. it stays heavy at fremont. 7:38. let's go to steve. thank you, sir. well, we have some breaks in the low clouds. before we get started here, i teased signs of an early winter. we'll see. the writer at the chronicle is about ready to write an article. tom always does. july started the shar da nay grapes early -- char da nay grapes -- shardanay grapes earlier. something has to break. maybe these are signs. i would be interested to see what tom has to say. we do have breaks on the fog. there's some there. it will burn off sooner. the wind has been cranking up. there will be sun in san francisco. but the july information

continues to come in as we have said yesterday, 26 out of 31 days in san francisco had fog. that's a lot. i mean, the temperatures came in about average, though. the mean temperature was 60.1. the mean maximum temperature 66.63. 66-point a. you are right there. the minimum temperature, 54.1 was the average. so very close here. i think the big story was the fog. normal high is 67 degrees. the last time it was 70 degrees or higher in san francisco was the supply when it was 75. not today. 65. still slightly below average but at least starting to get some sun. the breeze -- i mean, from san francisco, out to the altamont pass in fairfield, there's a good breeze kicking unof the lows i -- up. the lows were the big story for some from marin, napa county, mendocino county and sonoma county. we had a lot of 40s. there are breaks in the fog.

i said patchy fog. there's some low clouds. some sun along the coast. but the pattern for the first 10, 14 days of august looks about like this. it's kind of steady. no sign of any extreme one way or another although liening toward a slightly cooler pattern. mostly sunny, 86 in -- that's not bad. 87 vacaville. could be a lot worse. 80 novato, 77 san rafael. sausalito, 68. 78 concord. 78 walnut creek with a breeze. danville, san ramon, upper 70s. 60s, 70s, alameda, berkeley, oakland san jose only 76. warmer santa clara valley you would expect that. even with the sun, though, the coast is dealing with mainly 60s. there's too much of a northwest breeze. low 7s on 0 -- low 7s -- low 70s on the peninsula.

stocks opening higher in walt. the s&p is above 1700 points for the first time. taking a live look, the dow is also up at a new record level. it is up by 133 points at 15,633. the nasdaq is up 40 and the s&p up 18, at 1703. also helping the markets, the number of americans applying for unemployment benefits fell to its lowest level in five and a half years. this morning, the labor department reported 326,000 people filed first time claims. that's down 19,000 from the

construction site on international and took money and cell phones. the men beat the men. a gun went off. no one was shot. the contractor who didn't want to show his face said construction workers are targeted often. >> the individuals come out and target specifically latinos who think they are illegal and don't have papers or b, they have cash on them and won't report the crime. >> police are still out there searching for the suspects. some of the residents in san francisco's castro districts are nervous after a number of high-profile crimes lately. residents say the police are not doing enough to protect them. that's why police chief greg suhr led a community forum last night. police heard some of the concerns. they passed out whistles, too, just as a safety precaution. one person we talked to says he and his husband were recently held up at gunpoint. >> i was pushed to the ground and somebody was on top of me.

i looked up and i saw a gun. >> police say there have been a few robberies but overall, it's still a safe neighborhood. a notorious cige happened more than a month ago. you will recall surveillance video showed a man kicking a woman in the face during pride week celebrations on june 30th. this happened near market and delores streets. san francisco police say a tip has led to the arrest of a 23- year-old suspect, christopher porter bailey of oakland. officers say the victim was fortunate and did not suffer any lasting physical injuries. same-sex couples tied the knot at midnight as gay marriage became legal in san francisco. [inaudible] [ cheers and applause ]

>> dozens of gay couples exchanged gas at minneapolis city hall. weddings were held overnight in county courthouses across the state and the mall of america. same-sex marriages became legal today in rhode island. 13 states including california now allow gay marriage along with the district of columbia. a california teenager wants jerry brown to sign a bill that would allow transgender students to use restrooms, locker rooms or join sports teams based on the gender they identify with. yesterday a 16-year-old transgender student from manteca delivered a petition and took it to brown's desk. the bill was introduced by tom amiano. and two elected leaders in the south bay are demanding an end to a 30-year-old policy

he was told to put the gun away in the glove compartment. zimmerman was allowed to drive away with just a warning. back here at home, a california commute survey has found more than half of bay area workers drive to work alone. stated statewide, a poll of more than 2,000 adults indicates 16% use public transit. 14%, carpool to work. 5% ride bikes. overall, the number of commuters driving solo has gone down a lot from ten years ago. there's been a sizable increase for people using public transit. >> that's good news. there's still a lot of solo drivers out there and people on the road. let's check in with sal. 280 in san jose? >> yes, slow, 280 northbound driving up to the silicon valley. the traffic will be busy. it's slow on 101 at 85 as well. it's improving a little bit. northbound 17 at bear creek,

welcome back to "mornings on 2." i'm tori campbell. >> good morning. i'm dave clark. let's check weather, traffic. steve's back again. interesting forecast for you today. >> well, there's a lot going on. >> yeah. >> we'll get sun by the coast. but the wind patterns are nutty. some areas hardly have a breeze. others, 25, 35 miles an hour. it will be sunny, coast, bay, inland. sunny, breezy. kind of on the cool side with the 60s, 70s and 80s. westbound 24 between walnut creek and oakland, a little bit of slow traffic here in la fayette. nothing major, though, and it has been a decent drive today. this is 280. the south bay is heavy all over the place. you can see right here, 280 northbound getting up to highway 17 remains heavy all the way up in the valley.

an investigation is happening in the south bay after a bomb said she was -- woman said she was attacked. it happened at 1:00 a.m. near santa clara university. ktvu's janine de la vega has been on this since early this morning. what do you know, janine? >> police say this appears to be a random attack which is pretty unusual for the city of slar for somebody to be randomly assaulted. it's really unsettling for people who live in this neighborhood. it's just blocks away from santa clara university and this assault happened on lexington near the mission branch library. police say the assault happened shortly after 1:30 this morning. a woman in her 20s finished hanging out with her friends close to a 7/11 near the campus. officers say while she was walking home alone on lexington near main, that's when a man grabbed her from behind, told her not to scream. police say she fought back. she kicked him in the groin and

ran away. police dogs picked up a accident at lexenton but it ended there. >> i think a little more security, a little more cautious eye, a little less care-free attitude. we typically leave the windows overnight at night to get a nice breeze. cool down the house. maybe we'll lock them up for a while. >> police don't believe this incident is related to a rape that hasn'ted last friday at an apartment complex at homestead and kylie. that's because there was no indication that this battery was se ual in nature. they don't -- se ual in nature -- sexual in nature. they don't have a motive. at this point, since they don't have a good suspect description from the victim, there's no active search but they are investigating this. university police is aware of the incident even though they

didn't assist. we have a call into a campus spokesperson to see how they are gonna go about alerting students even though right now, school is not in session but they are possibly thinking about putting it out on some sort of emergency alert system. reporting live from santa clara, janine de la vega, ktvu channel 2 news. police at san jose state university made an arrest for a brutal beating that happened tuesday night. police are comerkted to -- are expected to give us more details later today. the 22-year-old victim still recovering. the attacker bashed his head on the sidewalk near the science building. it appears the victim and attacker knew each other. that victim was not a student there and had no ties to the university. 8:02 -- 8:02. police are investigating a shooting on a deadly street. police found two men shot inside a car on somersville road. one man died. the other is critically

injured. claudine wong has been live at the shooting scene since had:30. what are we learning -- since 4:30. what are we learning, claudine? >> reporter: this area is open. cars are moving through. it gives you an idea of how busy this roadway is. actually, there's astill some glass on -- there's still some glass on the street. that's where the shooting happened on delta fair boulevard. there are two crime scenes. we can take you through what happened. i want to show you the video we shot first. this is the police collecting evidence which is delta fair. this is where police say the shots were actually fired. it appears at this point that these two men, one from richmond, the other from vallejo, were driving down the street around 7:45 when another car drove up and the person or persons inside started shooting. they did not stop.

the two drove about a half-mile away from somersville road in buchanan. that's where officers found them. the man from richmond was pronounced dead. the other man from vallejo was at last word in critical condition at the hospital. police are still trying to notify the victim's family. we're not getting ages or any more specific information about that. we're told the men have ties to antioch. not sure if that means they have family or friends here. we want to show you a description of the suspect vehicle. it's described as a four-door honda or chevy. we don't know the model. it's gold in color. that may make it stand out a little bit. anyone with information is asked to give antioch police a call. coming back out here live to delta fair boulevard and buchanan road. we can tell you what they did, they all fanned out. investigators were out. they came back together for a briefing. we are expecting to get more information on just what they've learned later today.

live here in an it eye -- in antioch, back to you. >> thank you. police are investigating a deadly shooting in east oakland. officers say they found a man who m been shot and killed just before midnight on 80th avenue near international boulevard. no information has been released about a suspect. investigators in san francisco are trying to determine what caused an early- morning fire in chinatown. it started around 3:00 this morning at a souvenir shop son clay street. not far from the financial district. no one was hurt. the fire caused an estimated $500,000 in damage. 8:05. a tragedy on the sonoma coast. that's where a teenager was killed in an atv accident. it happened last night near highway 1 and annapolis road about ten miles north of salt park. the victim was a 14-year-old or 15-year-old boy driving a four- wheel atv when it apparently flipped over. a search party went out to look for him when he didn't

come back to a campground. later today, a san rafael teenager accused of a crime spree is due back in court. 18-year-old max wade is due to stand trial next month on several charges. he's accused of firing shots at a couple in mill valley last year. he's also accused of stealing the lamborghini of celebrity chef guy fieri in 2011. that trial was due to start in may but a judge agreed to push it back to allow defense lawyers to go over the evidence. this morning's hearing is for a status report in the case. police in daly city are asking for the public ahelp in their church -- public's help for their help in a missing woman. she's not been seen since monday. investigators say she drove away from home in light blue, 2003 mercedes e-500. she had her 1-year-old yorkshire terrier. she speaks mandarin and cantonese.

and it's still below average, the normal high is 67. it's the inland temperatures that are actually running santa rosa to san jose. they should be closer to 83. they will be pea lee that today -- below that today. it will be a breezy day today. a lot of 40s showing up. we're in the 50s. these are definitely on the cooler side. some of that fog is there. but offshore there's some breaks. there will be some patchy fog. really not much going on. i mean, a steady as she goes

pattern. fog, sun, breezy to windy. cooler lows will give way to sunshine and mostly sunny skies. temperatures today, 60s, 70s and 80s. but again, clearlake, 87. vacaville, 86, 87. 78 walnut creek with a breeze. 76 san jose with a breeze. sunnyvale, 76. 60s on the coast. 70s for some. there have been gusts 30 miles an hour. interesting pattern. it will be warmer on friday. i think we settle right in near the weekend. >> all right, thank you. ten minutes after 8:00. later today, bug experts plan to do a second check of goodwill's warehouse in burlingame. they want to make absolutely sure there are no bedbugs at that facility. yesterday, specialty trained bug sniffing dog emerged from the warehouse. the dog found no trace of the pest. goodwill was forced to shut down the warehouse and another one in san francisco after bedbugs were found around the

doe flighted items. a new study shows that college students should be concerned about inflated grades. new research indicates that universities are likely to pick inflated grades. the researchers say the admission officers don't take into account which schools cap the gpas. cal is considering including class rankings when they send out transcripts to deal with that problem. the start of this school year means california state university students have a new option for classes. all cal state students can take online classes at any school in the system. students will be limited to one course per term offered on another campus. but they can take as many online classes at their own school as they want to. right now, there are about 30 cal state courses offered online. all right. we all still have a chance. no one picked all six numbers

low clouds, fog, sunshine. some breeze and wind. it will be a sunny, breezy day. highs 60s, 70s and mainly low 80s. chuck hagel has issued a dire warning about the effects of the sequester. he says federally mandated budget cuts would result in a military that's too small to handle major conflicts or a larger force that lacks proper equipment putting troops' lives in danger. he says in a worst-case scenario, the army could be reduced from 490,000 troops down to 380,000 troops. happening today -- in about three hours from right now, senator dianne feinstein will head over to the white house.

she'll join other lawmakers in a meeting with president obama about the domestic violence surveillance programs. all of this comes yesterday after the congressional hearing. here's kyla campbell. >> reporter: lawmakers are debating whether to rein in the nsa's authority to collect americans' phone and internet records. some of those lawmakers will be meeting with president obama. feinstein will be at the meeting. now, this comes after the "guardian" newspaper reported on an nsa program called xkeyscore. a journal says it allows the nsa to collect as much internet activity as it and then analyze it. he says that includes millions of personal e-mails and internet searches. the nsa tried assure lawmakers yesterday that only a tiny fraction of those records are ever viewed by nsa intelligence analysts. patrick leahy is the chairman

of the committee. he questioned whether or not the patriot act allows this activity. >> based on a secret legal interpretation of this statute it does not appear to authorize this. what's gonna be next? >> reporter: we expect that same question to be asked at this afternoon's meeting between lawmakers and the president. the obama administration has said the surveillance programs are key to spot terrorists but that some changes could be coming. live in washington, kyla campbell, ktvu channel 2 news snool ahead of the nsa -- a head of the nsa was heckled in las vegas at a cybersecurity conference. >> if you disagree with what we're doing, then you should help twice as much. >> read the constitution! >> i have. you should, too. >> that's the nsa director. he agreed to speak at the conference at ceaser's palace about what he called misconceptions about the nsa's surveillance program. he claims the surveillance

program disrupted more than 50 terrorist plots. however, the hackers say alexander violated the constitution. 8:17. tweter is getting more requests for more -- twitter is getting more requests for information about users all around the world. the united states still dominates the requests. the u.s. asks for information on almost 900 twitter users during the first six months of this year. that's about 75% of all government requests. governments usually want the e- mail addresses tied to a twitter account. there's another warning to everyone who uses social media. legal experts say if you post anything online, it can be used against you by police and prosecutors. but a new study shows most people don't realize that. >> the study indicates that more than half of the people out there who use social media don't realize that what they post on social media can be used against them in a court of

law. that was a big surprise to me. >> the website took part in the study. it found that younger people, college graduates and people with higher incomes were more aware of the laws surrounding social media. 8:18. a real close call for a samtrans bus and a train at menlo park yesterday. on tuesday, by the way, the bus smashed through a railroad crossing arm tuesday morning and drove across the train tracks seconds before a train came through. samtrans says five people were on the bus at the time. but luckily, no one was hurt. investigators are checking the surveillance video from the bus to find out exactly what happened. the southwest airlines flight from denver made a safe landing at mineta san jose airport yesterday. but that's after blowing a tire. the crash team was ready. they were waiting. a boeing 737 touched down yesterday afternoon. the pilots did say -- there was a flat tire after takeoff. the plane did land.

it taxied to thegate with no problems. this is video of the fair opening day last year. attendance dipped last year. so they hope the addition of wine tasting and concert headliner wang chung, they hope "everyone has fun tonight." randy travis is now out of the hospital. he's going to physical therapy now. travis spent three weeks in a texas hospital after having a heart attack and a stroke. he was in critical condition for several days and had surgery to relieve some of the pressure on his brain. his recovery will take several

months. 8:23. the permanent fix for the broken bolts on the new bay bridge is well underway. this crucial project is taking place miles away from the bridge. ktvu news went inside the plant in vallejo where the so-called seismic saddles are being made. workers are carefully bending special 3-inch thick still plates into something that looks like a saddle. the saddle cable system will be sealed and surrounded by concrete and a casing to complete this permanent fix. >> once you put them in, you pull the tendons tight, stretch them down, lock them off. and then it will be sealed and never exposed again. >> there's still a chance a span of the eastern bridge could be opened much earlier if they adopt a temporary fix now being tested. let's go to sal. have you straightened out the fog and other problems in our

commute? >> pretty foggy in the one picture. the fog is not a major problem, though. i think the problem is slow traffic this morning, dave. let's go out and start with the san mateo bridge. westbound 92 looks pretty good. there are no major problems there. police were out near the high rise looking for a couple of people who were apparently doing a little road rage out there. watch for police cars to be descending into that area. bay bridge looks pretty good westbound. there is a small delay at the toll plaza but traffic continues to move along pretty well. westbound 580 hop yard getting new details of a crash on westbound 580. this is exactly what we don't need. we've had very heavy traffic the entire way. now livermore to dublin is just messed up. it's one of those things where you can't catch a break on 580 between livermore and dublin this morning. it's terrible. let's go to steve. thank you, we have some

oakland" is planning to attend the event. police have decided to beef up their staff. we noticed there were a dozen transport vans already lined up at headquarters. police are on alert in police groups turn violent. union leaders say they had no idea that occupy was planning to attend. they are calling for peaceful protests. the next 24 hours, the it's critical. b.a.r.t. management has not responded to the last offer made july 27th. if they don't, they will issue a strike notice. >> i'm very concerned about the deadline looming on sunday. our team is very concerned. our passengers are very concerned. we're doing everything we can from the union's standpoint to ensure that a contract is ratified but we cannot barken by our -- bargain by ourselves.

will likely issue a 72-hour strike notice if there are no major developments today. two of the biggest sticking points have been over contributions to healthcare and pension plans. pam cook joins us now with some new numbers from b.a.r.t. pam? >> similar to what many companies and employees are going through, the cost of benefits is often on the table. b.a.r.t. has been arguing that it faces billions of dollars in unfunded needs to keep the trains running smoothly and safely. b.a.r.t. says it spent $17 million last year to pick up the employees' share of pensions but if employees pay part of their share, b.a.r.t. says it could use that savings to make critical investments to the system. b.a.r.t. released a statement saying "there's no question that employees should get a raise. but contracts that continue to allow employees pay nothing toward their pension and a flat rate for healthcare are no

longer sustainable." that flat rate is $92 a month, regardless of how many dependents an employee has. b.a.r.t.'s numbers there released on the chart show that's about 1.3% of a b.a.r.t. worker's salary. that compares to a 3% contribution from a.c. transit workers, 3% to 8% from golden gate transit workers and as much as $2,000 a month for a whole family covered under sf muni's plan. b.a.r.t. also makes comparisons between the workers and local municipalities and utilities. in terms of pension contributions, this is the chart. b.a.r.t. employees pay nothing. east bay m.u.d. workers pay 7% of their salary toward pension. workers at the port of oakland pay 8% and many city workers here in the bay area pay 5% to 8%. we've heard from the union that they have arced that they are a -- arced that they are a highly
